Reward Offered in San Diego Auto Accident

A 36-year-old San Diego husband and father died yesterday when his car slid on a freeway off ramp and slammed into a trash truck on Federal Blvd. Jose Lerma lost control of his car when it traveled over a large patch of used oil that police say was illegally dumped there earlier in the day. Witnesses say Lerma fishtailed in the oil and lost control and crashed.

Police are looking for help in finding the individuals who dumped the oil, which police estimate was four five-gallon buckets. San Diego Crime Stoppers has offered a $1,000 reward, and are encouraging those with any information to call the Crime Stoppers tip line at (888) 580-8477.

Elderly Driver Crashes into Building, Kills Man

An elderly driver pulling into a parking spot at a Tierrasanta medical building was unable to put her foot on the brake, and to stop her car as it crashed into the lobby of the building, striking a man. The accident occurred two weeks ago, but police will recommend the 89-year-old driver be charged with vehicular manslaughter after man died due to his injuries.

According to reports, the car ran over a pole and into the glass windows that fronted the building. The man was visiting his dentist, and was pushed back 20 feet and pinned against a wall before being freed by firefighters. He suffered multiple fractures, and went into cardiopulmonary arrest at the scene. He never recovered.

Motorcycle Accidents Continue Despite Safety Measures

When it became clear that young Marines were dying at an alarming rate in motorcycle accidents, Marine Corp leaders created safety courses for riders to build riding skills and safety awareness. According to reports, those courses have apparently not worked as there have already been seven Marines killed in motorcycle accidents this year, the same amount as this time last year.

Despite the number of fatalities, officials hope that the new safety program will start to show its effectiveness by the end of summer. Those who have participated in the safety course, Marine leaders say, have already become safer riders.

The Marine Corp has regular safety courses, including "track days" that allow riders to ride on a designated course at top speeds in a controlled environment. They also invite professional riders, and motorcycle schools to the base to discuss rider safety.

Most Fatal Commercial Trucking Accidents Caused By Passenger Cars

The California Highway Patrol is out with a report today designed to educate drivers on traffic safety when in proximity to a big rig truck. According to the report, of the 7,262 accidents involving commercial trucks last year, 56% were the fault of the driver inside the passenger vehicle, such as a car, pick-up or other non-commercial vehicle.

In Orange County, 616 people were injured in 452 accidents involving big rigs in 2007, including 17 fatalities. In San Diego County, 349 people were injured, with 19 fatalities. And in Riverside, 477 people were injured, including 24 fatalities. To read the full report, click here (.pdf)

Woman Suffers Major Spinal Cord Injury During Turbulence

A woman became paralyzed on a Continental flight after she disobeyed warnings to remain seated during a turbulent flight. According to reports, the woman got up and went to the bathroom despite the warning, and was thrown to the ceiling when the plane hit turbulence.

As a result of the injury, the woman suffered a major spinal cord injury, including fractures to her C1 and C2 vertebrae. Known has a "hangman's fracture," she now is paralyzed from her chest down. This the same type of injury suffered by Christopher Reeves. It is unknown whether she will ever walk again.

Two other people were injured on the flight, including a passenger that suffered a torn ligament in her knee.

Vista Scooter Accident Claims Life

A San Marcos woman riding her scooter died after being cut off by negligent driver. The 59-year-old woman was traveling east on South Santa Fe Avenue early Saturday afternoon when she was struck by a small car as she traveled through Mar Vista Drive. According to reports, the car was attempting to turn left into a convenience store when it struck the woman.

The San Diego Sheriff's Department is investigating the accident, and no arrests have been made.

AIG Sells Auto Insurance Business for $2 billion

The troubled company AIG has just sold is automobile insurance arm - 21st Century Insurance - to Zurich Financial Services for $2 billion. Zurich will fold the new purchase into its car insurance business Farmers Group.

We'll have to wait and see what does to auto insurance rates, or Farmers current ranking as the 7th worse insurance company in America.

San Diego Car Accident Claims Life of Child

It has happened again. The driver of a vehicle loses control "for unknown reasons" and causes a catastrophic automobile accident. Several of these accidents have been blogged about here, but most haven't. It leads to one inescapable conclusion: the use of cell phones while driving.

Shortly after 5:00 a.m. this morning a 2-year-old boy died when the Chevy Silverado he was riding in was sideswiped by a BMW that lost control on northbound I-805. According to reports, the BMS moved to the right, and hit the Chevy truck, causing it overturn on the shoulder. The boy was belted in a car seat, but the seat was ejected due to the force of the accident.

The police have no word as to what caused the accident, but no doubt the use of a cell phone, whether talking or texting, was involved. (See prior similar accidents here and here).

Pedestrian Accident Claims Life, Police Look for Suspect

A 43-year-old pedestrian was struck and killed in Santa Ana when he was struck by a small black car while crossing First Street west of Jackson Street. The accident occurred about 9:45 p.m. on Saturday, April 11. The victim died at the scene.

According to witnesses, the black car fled westbound, and probably has damage on its front end. Anyone with tips should call the Santa Ana Police Department at (714) 245-8665.

Doctors Don’t Flee States Because of Malpractice Claims

Every few years we hear about doctors fleeing states to get away from high malpractice insurance premiums. The medical malpractice insurers then claim they have to raise rates because of excessive malpractice lawsuits. Then the legislatures get nervous and enact laws that limit when and how victims of malpractice can sue, and how much they can collect in the form of caps. And guess what? It’s all a sham.

A study by the American Medical Association shows that doctors do not flee states without so-called tort reform measures, but that the numbers of doctors continues to climb in every state. Moreover, the number of doctors per capita is 13 percent higher in states without caps on recovery. That’s right, the states where there is no arbitrarily imposed ceiling on what a malpractice victim can collect actually has more doctors per capita than those with laws designed to retain doctors.

Next time you hear insurance company and state legislators that we need to impose limits on civil justice to prevent doctors from leaving California, be very wary. They did this in the early seventies and the effect has been devastating to those severely injured by medical malpractice.

Big Rigs Banned from Highway after Accident

After a fatal big rig accident, California's top transportation official has temporarily banned large commercial trucks from Angeles Crest Highway for a period of 90 days.

On Wednesday, a big rig truck transporting automobiles lost its brakes while driving down a steep grade on the Southern California highway. The large truck smashed into several cars - killing a young girl and her father - then crashed into the window of a bookstore, injuring several others.

As a result of the accident, felony charges of vehicular manslaughter were filed against the driver of the truck Marcos Costa of Massachusetts.

The Myth of the "Independent" Medical Exam

The New York Times is out with a story about independent medical exams - or IMEs - in the state's beleaguered worker's compensation system. The article more or less confirms what injury attorneys all over the county already know: there is nothing "independent" about IMEs.

Generally speaking, an insurance company in a personal injury or workers compensation claim has a right to conduct a medical exam of the claimant to confirm the injuries are legitimate. But what usually happens is the doctor - hired by the insurance company - will issue a report that either dispute, denies, or down-plays the injury.

The Times article (which can be found here) starts with the story of plumber, injured on the job, who seeks more time under his work comp claim. The doctor conducts an exam, and appears to confirm all of the plumber's injuries and complaints of pain. But when the doctor issued the report, it reported the plumber had no injuries. According to the doctor, he couldn't be truthful because it would hurt is standing with the insurance company:

“If you did a truly pure report,” the doctor said, “you’d be out on your ears and the insurers wouldn’t pay for it. You have to give them what they want, or you’re in Florida. That’s the game, baby.”

So who gets screwed? The injured person, now twice victimized. While this doctor is in New York, he has many brethren in San Diego. There are IME doctors here who make hundreds of thousands of dollars working for the same insurance companies, and who routinely issues reports that dispute the injured party's claims, or disparage the character of the victim.

I had a client who had her tongue pierced. She suffered a neck injury in a car accident and was sent to an IME with a particularly notorious San Diego defense doctor. When the report came back, the doctor spent a paragraph talking about the black spot on the x-ray with turned out to be a piece of jewelry in the woman's tongue. He went on to call her a malingerer (a liar), and concluded that she had no discernable injury.

What did a tongue piercing have to do with her neck injury? Nothing, of course. It was just this doctor's way of diminishing the character of the patient before him, hoping that somewhere down the road, either an insurance adjuster or jury, will judge her wrongly and reduce the value of her claim. I guess “that’s the game, baby,” but it is a pathetic game indeed.

Punitive Damages Award Upheld by U.S. Supreme Court

The U.S. Supreme Court dismissed an appeal by cigarette manufacturer Philip Morris to overturn a state verdict of $79.9 million awarded to the widow of a longtime smoker by an Oregon jury. Legal analysts believe the ruling may mark a shift in the court, who most consider to be decidedly "pro business" it its rulings.

The court's ruling ended a decade-long battle for Mayola Williams, the widow of Jess Williams, a Portland Oregon janitor and smoker who died of lung cancer. In the product liability lawsuit, the family argued that Jesse, who began smoking in the 1950s, believed that cigarettes would not harm his health because of representations made by the cigarette company. A state jury agreed, awarding Mayola over $800,000 in compensatory damages, and $79.5 million in punitive damages.

Organized business interests had hoped the high court would send a strong warning to state courts about excessive punitive awards, and clarify a constitutional limit, but that was not to be the case.
