Sleeping Street Sweeper Kills Bicyclist on San Diego Roadway

February 14, 2011

A 77-year-old man driving a street sweeper fell asleep behind the wheel and veered into that path and striking a bicyclist on Friday. The cyclist, 44-year-old Suntat Peverley of Mira Mesa, died later that evening.

According to reports, the street sweeper was traveling southbound on Genesee Avenue near Clairemont Mesa Blvd. when it came up behind Peverley and, without slowing, struck him from behind. Peverley was thrown to the pavement, striking his head, and causing a severe brain injury. The victim was wearing a helmet.

What is also unclear is who the street sweeper was working for at the time of the incident, and why he was out in the busy streets during rush-hour on a Friday. Also, what is a 77-year-old doing operating heavy equipment? No doubt these answers will be sought in the legal action the family should certainly pursue.

Taxi Driver Plows into San Diego Gaslamp Crowd

February 12, 2011

Six pedestrians were critically injured, and nearly 20 more hurt, when a taxi driver drove his cab onto a curb and plowed into a crowd leaving a night club in the Gaslamp District. The force of impact amputated one woman's leg below the knee.

According to reports, the Emerald Taxi cab was heading south on Sixth Street around 2 a.m. when it suddenly, and for no apparent reason, veered onto the sidewalk and into the crowd. The taxi came to a rest near the front doors of the Stingaree club on the corner of Sixth and Jarvis. People in the crowd attacked the driver, who suffered a broken nose and was also hospitalized.

Police aren't sure what caused the driver to veer into the crowd, but early indications are that it may have been intentional. Police said alcohol was not likely a factor, but one witness said that the driver "seemed to be out of it."

The injured were taken to area hospitals including UCSD Medical Center and Scripps Mercy, Sharp Memorial, Alvarado, Scripps La Jolla, Coronado, Paradise Valley and Scripps Chula Vista. A total of 12 ambulances were used.

The injured will likely have a viable personal injury case against the driver of the cab and the company he works for. But considering the number of victims, it is doubtful the company will have sufficient insurance, particularly considering there is an amputation, which can be very high value cases. The investigation is ongoing.

Accident Involving Wrong-Way Driver Caught on Tape

February 8, 2011

No one was seriously injured after a spectacular crash on I-5 near Las Pulgas Road in Oceanside. An 83-year-old driver identified as Clarence Kinney was driving a Ford F-150 when he entered the northbound lanes of the free, but drove south. A quick thinking driver on the southbound side of the freeway noticed the man, and recorded the accident on his cell phone. It's pretty dramatic (link below).

It appears that Kinney doesn't even realize that he is on the wrong side of the freeway, and is just cruising at a high rate of speed. All of a sudden, he slams his truck into the concrete center divider, and caroms into oncoming lanes. The video ends there, but reports state that Kinney's truck was then t-boned by a Land Rover, which split his truck in half. The cab portion of Kinney's truck was then hit by a big rig truck, which itself lost control and crashed. A minivan also was involved.

Incredibly, no one suffered serious injuries. Kinney, who was battered like a pinball was taken to a hospital and reported to only have minor injuries. No else needed medical attention. It turns out Kinney was driving with a suspended license.

Two pit bull terriers were confiscated and quarantined on Tuesday after they attacked and severly bit and elderly woman while walking in the Menifee neighborhood where she lives. Witnesses say Lona Bishop, 86, was attacked early Tuesday morning on Buckwheat Road in the southern part of Menifee.

Witnesses say that Bishop was badly hurt, and had large bites on her wrist and upper arm. A relative of the victim told the North County Times that the victim was taken to Loma Linda Medical Center where she will require surgery.

Neighbor Chris Aery said he was getting ready to leave the home when he heard his dogs barking in an unusual manner. He went outside he could hear Bishop screaming for help. He ran to help, and used a golf club that Bishop was carrying to chase the dogs away.

The dogs were confiscated by the Ramona Humane Society Animal Shelter because there were no records that the animals had been properly vaccinated. According to reports, the owner of the dogs lives in Oxnard, and was visiting his father, Pete Morales, who also lives on Buckwheat Road.

Aery told reporters that the pit bulls have been a problem along Buckwheat Road for quite some time, and that recently a new litter of puppies were seen on the property.

Walton Law Firm handled a very similar case to this recently when an elderly woman from Carlsbad was attacked by roaming English Bulldogs. She too suffered cuts to her arms, and also suffered a broken wrist. A lawsuit was brought against the owners of the dogs, and a settlement was obtained on behalf of the victim.
